GENERAL TERMS AND CONDITIONS OF SALE
THESE GENERAL TERMS AND CONDITIONS OF SALE APPLY TO ALL BOOKINGS MADE AT CHATEAU DES FLEURS BY AN INDIVIDUAL CUSTOMER.
1. Preamble
1. The purpose of the present general conditions is to define the terms and conditions under which the Château des Fleurs allows its clients (hereafter referred to as ‘the Client(s)’) to benefit from all of the services available, in particular reservations.

BH Champs Elysées SAS operates the Château des Fleurs reservation site. This Internet site allows rooms to be reserved at the hotel.

- Through agencies selected by the Château des Fleurs.
- Through our partners.
2. All bookings made via the www.chateaudesfleurs.paris website imply full and unreserved consultation and acceptance of these general terms and conditions as well as the terms and conditions of sale for the rate booked, which are expressly mentioned in the description of the rate selected at the time of booking.
The Customer must confirm by ticking the box that he/she has read and accepts these general conditions and the conditions of sale of the fare booked before definitively confirming his/her booking; no booking is possible without this agreement.
For all other booking methods, the Customer will receive the general terms and conditions of sale with the booking confirmation. Confirmation of a booking implies adherence to these terms and conditions of sale and full and unreserved acceptance of their provisions.
3. The Customer has the option of saving and editing these general terms and conditions using the standard functions of their browser or computer.
4. The Site contains the following information:
- the legal notice allowing precise identification of the company BH Champs Elysées SAS and indicating its corporate name, its registered office, its individual identification number for value added tax,
- the e-mail address and telephone number by which the Château des Fleurs can be contacted,
- the essential characteristics of the accommodation offered by the Château des Fleurs,
- the essential characteristics of the accommodation offered by the Château des Fleurs,
- the essential characteristics of the additional and optional services offered,
- the prices inclusive of all taxes,
- the conditions of sale of the reserved rate,
- the terms of payment,
- the general terms and conditions of sale,
- the period of validity of the offers and their price.
5. Prior to booking, the Customer declares that this booking is made for his/her personal needs. As a consumer, the Customer has specific rights, which would be called into question if the Services booked were not for personal use.
6. All the information provided on the www.chateaudesfleur.paris website is presented in French as well as in other foreign languages.
7. The Customer declares that he/she has full legal capacity to enter into commitments under these general terms and conditions.
Any reservation made by a minor (between 16 and 18 years of age) can only be taken into account by the Château des Fleurs after having obtained a signed release from the legal representatives of the minor making the reservation and any accompanying minors. The Château des Fleurs reserves the right to request any proof necessary to authenticate the signature of the release form.
2. Definitions
For the remainder of this document, the terms below shall have the following meaning:
- Booking Summary": a dematerialised document which summarises the characteristics of the Services selected by the Customer on the www.chateaudesfleurs.paris website. This document precedes the Customer's acceptance of these General Terms and Conditions of Sale and the Customer's entry of his/her bank details as part of a prepayment or guarantee.
- Booking Confirmation": dematerialised document sent to the Customer to inform them that their booking has been taken into account, which summarises the characteristics of the Services booked by the Customer on the www.chateaudesfleurs.paris website.
- Customer": a natural person acting exclusively for his/her own personal needs.
- Conditions of sale of the reserved rate": Price applied on the date selected by the Customer for a category of room with or without the breakfast option, associated with its payment conditions, its conditions for changing the dates of reservations or reserved Services and its cancellation conditions.
- Reservation request": means a request made by the Customer to reserve rooms, products and Services at the Château des Fleurs.
- Partners’ : refers to any service provider who has concluded a service provision contract or partnership agreement with the Château des Fleurs.
- Service": reservation of rooms, products and services at Château des Fleurs made by the Customer.
- Site": refers to the Internet site www.chateaudesfleurs.paris
3. Subject
1. The present general conditions define the rights and obligations of the Client and the operating company of the Château des Fleurs for all types of reservation (including remote reservations) of Services offered by the Château des Fleurs.
2. They govern all stages necessary for the reservation and follow-up of the reservation between the contracting parties.
3. The Customer acknowledges having read and accepted these General Terms and Conditions of Sale and the Terms and Conditions of Sale for the fare booked.
4. Modifications
BH Hotels SAS reserves the right to modify or supplement all or part of these general terms and conditions of sale at any time. In this case, the new version of the general terms and conditions will be available on the Site with its effective date. The Customer is advised to consult the general terms and conditions of sale regularly to take note of any changes. In any event, the Customer will only be bound by the version of the general terms and conditions in force at the time when the Customer books his Service.
BH Champs Elysées SAS shall not be held liable for any damage of any kind that may result from these changes and/or from the temporary unavailability or definitive closure of all or part of the Site or of the Services associated with it, such as the online reservation area, the private area or the unavailability of the reservation centre.
5. Booking
1. The Customer chooses Services from those offered by Château des Fleurs according to their needs.
2. The Client declares that they have obtained from the Château des Fleurs all the information necessary to make their choice and to proceed with their reservation.
3. The Customer acknowledges having taken note of the nature, price, destination and booking conditions of the Services available and having requested and obtained the necessary and/or additional information, in particular the Conditions of sale of the rate booked, in order to make their booking with full knowledge of the facts.
4. The Customer may book, on an individual basis, a maximum of three (4) rooms per booking on the Site. To book a larger number of rooms, the Customer may contact the sales team at sales@chateaudf.com.
5. The Customer is solely responsible for their choice of Services and their suitability to their needs, such that Château des Fleurs cannot be held liable in this respect.
6. The reservation is deemed to have been accepted by the Client at the end of the reservation process.
7. All reservations are nominative and may under no circumstances be transferred to a third party, whether free of charge or in return for payment. Any reservation made for a third party must be made in the name of the third party holding the holiday.
6. Booking process
1. Reservations made by the Customer are made directly online on the Site or via the reservations department on +33 (0)1 47 20 41 73.
2. The booking request is confirmed as soon as the Customer has received the Booking Confirmation sent by Château des Fleurs.
3. The Customer undertakes, prior to any reservation, to complete the compulsory information requested when creating the reservation file.
4. The Client attests to the truthfulness and accuracy of the information provided.
5. The reservation procedure includes the following stages:
- Stage 1 - Choice of room and Conditions of sale for the rate booked,
- Stage 2 - Selection, where applicable, of one or more additional services offered,
- Step 3 - Presentation of the summary of the booking, its total price, the Terms and Conditions of sale of the rate booked, which includes in particular the payment terms and Conditions of cancellation, modifications if necessary to the choice of services (date, room, rate, additional service), and information concerning tourist tax,
- Step 4 - Registration of contact details by the Customer,
- Step 5 - General Terms and Conditions of Sale:
On the Site, by ticking the box, the Customer confirms that he/she has read and accepts these General Terms and Conditions and the Terms and Conditions of Sale for the rate booked before definitively confirming his/her reservation; no reservation is possible without this agreement.
For all other booking methods, the Customer will receive the general terms and conditions of sale with confirmation of their booking. Confirmation of the booking implies acceptance of these terms and conditions of sale and full and unreserved acceptance of their provisions.
- Step 6 - Recording of credit card numbers in the event of a guarantee or prepayment request,
- Step 7 - Confirmation and validation of the booking and payment by the Customer. Entering the bank details constitutes the Customer's acceptance and has the effect of contractually committing the Customer to the Château des Fleurs.
- Stage 8 - Receipt by the Customer of the booking confirmation e-mail. This email summarises the date the reservation was made, the Services reserved, the prices including VAT with details of applicable taxes, the Conditions of Sale for the rate reserved (including cancellation conditions), accepted by the Customer, the general conditions of sale and the address of the Château des Fleurs.
If the confirmation email is not received within 24 hours of the Reservation, it is the Client's responsibility to contact the Château des Fleurs in order to ensure that the information provided is correct and that the reservation has been taken into account.
7. Cancellation or modification by the Client
1. In accordance with article L. 221-28-12 of the French Consumer Code, the Customer is reminded that he/she does not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code.
2. The Conditions of Sale for the fare booked and accepted by the Customer specify the terms and conditions for cancelling and/or modifying the booking. Bookings with prepayment for a non-refundable and non-cancellable fare cannot be modified and/or cancelled.
3. In the case of bookings with pre-payment for a non-refundable and non-cancellable rate, no refund will be given in the event of interruption of the stay.
4. Where permitted by the Conditions of Sale for the fare booked:
- The cancellation of a reservation made from the Site can be made directly on the Site via the ‘Your reservations’ section, or with the Château des Fleurs. For bookings made with the Château des Fleurs, cancellations can only be made with this hotel.
- Changes to the reservation can be made directly with the Château des Fleurs, whose telephone number is specified on the confirmation email received by the Customer.
- In the event of a ‘no show’, i.e. in the event of a reservation not being cancelled but for which the Customer has not arrived at the Château des Fleurs on the planned date of arrival, and insofar as the reservation has been guaranteed by credit card or prepaid, the Château des Fleurs will debit, as compensation, the sum of one night reserved, or will not reimburse the sum paid as prepayment.
If more than one night is booked, the cancellation conditions will apply in accordance with the Conditions of Sale for the rate booked.
8. Cancellation by the Hotel
In the event that it is impossible to make the reserved room available to the Customer or in the event of an exceptional event or in the event of force majeure, the Château des Fleurs may offer the Customer an alternative accommodation solution or, failing this, a refund of the total amount paid for the stay. The alternative accommodation offered will be in a hotel of at least an equivalent category or, if it is of a lower category, a room of a higher standard than that originally booked, for services of the same nature.
Any additional costs associated with this relocation, for services of the same nature, will be borne by the Château des Fleurs originally booked. In the event of a rehousing procedure, the Customer may also request the cancellation of their reservation, which will then give rise to an immediate refund.
9. Stay at the Château des Fleurs
1. All persons staying in the establishment must present a valid form of identification at check-in. If they fail to do so, the Château des Fleurs may refuse to rent them a room and/or cancel the reservation they have made without the possibility, where applicable, of reimbursement, in accordance with the Conditions of Sale for the rate reserved.
Foreign guests, including accompanying persons and adolescents over 15 years of age, must complete an ‘individual police form’.
Children under the age of fifteen may appear on the card of an accompanying adult. The information contained in these forms is governed by article R.611-42 of the Code de l'Entrée et du Séjour des Etrangers et du Droit d'Asile.
The customer may not bring third parties into the room without the express authorisation of the Château des Fleurs, which reserves the right to carry out any necessary checks.
2. Cats and dogs are welcome provided that they are kept on a lead in all the common areas of the establishment, it being specified that the Château des Fleurs may refuse to accept any pet or other animal likely to present a safety risk for the other occupants, the assessment of this risk being left to the discretion of the Château des Fleurs. For reasons of hygiene, animals are not allowed in the restaurant areas (these provisions do not apply to guide or assistance dogs).
To ensure everyone's peace and quiet, pets must not be left unattended.
You may be charged an additional fee per animal. Please refer to the Site for details of acceptance conditions.
3. The Customer accepts and undertakes to use the room and the communal areas made available to him/her in a reasonable manner. Any behaviour contrary to the principles of safety and/or hygiene, good morals and/or public order may lead the Château des Fleurs to ask the Customer to leave the establishment, without reimbursement.
4. Any damage caused by the Client or by the occupants of the room or in the various areas occupied by the Client during his/her stay must be reported to the Hotel reception or to the person in charge and may be invoiced directly to the Client for the cost of repairing the damage.
For safety reasons and out of respect for everyone, smoking is strictly prohibited on the hotel premises. In accordance with the provisions of the French Public Health Code setting out the conditions for the application of the ban on smoking in places designated for collective use, smoking in the Hotel exposes the Customer to the fine provided for third-class offences or to legal proceedings.
Penalties equal to a maximum of the price of the room booked may be applied if the Customer does not comply with the notice prohibiting smoking in his/her room.
5. The Château des Fleurs has Internal Regulations for the use of the Customer. The Customer accepts and undertakes to comply with the aforementioned regulations, the provisions of which apply both to him/herself and to any occupants of his/her property. In the event of a breach of the aforementioned regulations, the Château des Fleurs may immediately evict the Customer and all persons sharing his/her stay, without any compensation and/or without any reimbursement if payment has already been made. It may also refuse any future reservation, as well as all other hotels in the group.
6. Unless expressly agreed otherwise, the Customer must leave the room before 12.00 noon on the day the reservation ends. Failure to do so will result in an additional night being charged.
7. In the context of a health crisis or any other exceptional circumstance, if measures restricting access or even banning the use of certain areas open to the public were to be taken by the Government or any other competent authority, the Client is informed that the Château des Fleurs may not make certain services other than accommodation available (access to the restaurant, swimming pool, gym, spa, etc.) or make these services available in part, without the Château des Fleurs being held responsible. The Château des Fleurs will do its utmost to bring this information to the attention of the Customer on the Site and/or on any other medium, as soon as possible.
The Customer may not claim any reimbursement of the price paid or any discount.
10. Liability
1. In accordance with the laws and regulations governing intellectual property rights, the use and/or reproduction of all or part of the elements making up the offers on the Site are strictly forbidden, as is any reproduction of the decor and/or characteristic elements of the Château des Fleurs.
In order to respect the privacy and image rights of other Château des Fleurs clients, the Client undertakes not to take photographs of them on the premises of the Hotel or its outbuildings and/or not to publish photographs taken under such conditions.
2. The Château des Fleurs will not be held responsible for any direct or indirect damage resulting from the actions of a third party, the Client or the partners of the Château des Fleurs. 3. Hypertext links may lead to other Château des Fleurs sites, which accepts no responsibility for the content of these sites or the services offered. BH Champs Elysées SAS has implemented measures to protect and secure its information system against malicious acts, however, connecting to the Site and making a reservation implies that the Customer is aware of and accepts the characteristics and limits of the Internet, the lack of protection of certain data against possible misappropriation or piracy or the risk of contamination by any viruses circulating on the network. BH Champs Elysées SAS declines all responsibility in the event of misuse or incident linked to the use of the computer or any support allowing access to the Internet, the maintenance or malfunction of the website or any other technical connection and the sending of information to an incorrect address.
4. Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the order at the Customer's expense, without prejudice to any civil or criminal action against the Customer.
5. The Château des Fleurs reserves the right not to receive or to expel, without reimbursement, customers whose clothing is indecent, whose clothing is intended to conceal the face (Law N°2010-1192 of 11 October 2010),
customers whose behaviour is noisy, improper or alcoholic, customers whose behaviour is contrary to hygiene, public decency or public order. Correct dress is required in the restaurants and in the public areas of the Hotel.
Customers must be courteous and respectful towards Hotel staff. The Customer shall refrain from any verbal or physical violence, any racist behaviour or remarks or any form of harassment towards staff, on pain of exclusion without refund.
11. Prices
1. The prices relating to the reservation of Services are communicated before and at the time of reservation.
2. The prices quoted are per room for the number of person(s) and date(s) selected. Unless otherwise stated, additional services (breakfast, half board, full board, etc.) are not included in the price. When the Customer's booking is confirmed, the total cost of the Services booked will be indicated.
Prices include the VAT applicable on the day of booking and any change in the VAT rate will automatically be reflected in the prices indicated on the invoice date.
3. Prices are confirmed to the Customer inclusive of all taxes, in the Hotel's commercial currency (the Euro), which in some cases may be different from the establishment's local currency. The prices quoted are valid for a specific period only. All reservations are payable in the Hotel's local currency.
4. If a tariff requires payment to be made to the Château des Fleurs in a currency other than that confirmed on the booking, the cost of exchange (conversion and bank charges) will be borne by the Customer. It should be noted that if there is a conversion of the currency confirmed on the booking into another currency, this is given purely as an indication and is not contractual, particularly in view of possible changes in exchange rates between the date of booking and the date of stay at the establishment.
5. The tourist tax, and any other tax specific to the communes indicated for each rate, must be paid directly to the Hotel except in the case of online prepayment where this amount may be included.
6. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated on the invoice date. Prices may be increased by different taxes depending on the city/country. These taxes will be communicated to the Customer at the time of booking, if they are known to the Hotel at that time. Otherwise, they will be displayed at the Château des Fleurs reception desk. The Client undertakes to pay the various taxes, without any dispute, to the Château des Fleurs.
12. Payment
1. The Customer provides his/her payment details either (i) to prepay the reservation before the stay, or (ii) as a guarantee for the reservation in the event of a ‘no show’. In the case of a bank card, the information required is: the bank card number, with no spaces between the digits, the date of validity (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram in the case of prepayment.
The Château des Fleurs has chosen SyStemPay to secure remote prepayments. The Customer's payment card is subject to security checks (control of outstanding amounts, control of the country of the card, control of the country of the IP...... address)
by the designated partner and may be refused for a number of reasons: stolen or blocked card, ceiling reached, input error, etc. In the event of a problem, the Customer must contact his bank on the one hand, and the Establishment or any other entity on the other, to confirm his reservation of the Service and his method of payment.
The means of online payment available and communicated may be Visa and Mastercard, American Express, etc. This list is subject to change. This list is subject to change.
2. Payment is debited at the Château des Fleurs during the stay, except in the case of special conditions or rates where payment is debited at the time of booking (prepayment on certain rates).
3. In the event of payment to the Château des Fleurs, the latter may accept different means of payment, but the Customer must present the Establishment with the bank card that was used to guarantee the reservation or to make the pre-payment in order to ensure the Customer's identity. The Château des Fleurs may also ask the Customer to show proof of identity in order to prevent credit card fraud.
4. Any cash payment may not exceed 1,000 euros. If the Customer's tax domicile is abroad, the cash payment may not exceed 15,000 euros.
If the Customer has not prepaid for his/her stay, the Establishment will ask the Customer, on arrival, for a deposit or authorisation to debit the bank card in order to guarantee the stay corresponding to the total amount of the nights booked plus a flat-rate amount of 100 euros per person per day in order to guarantee the extras. The same guarantee will be required from third party guests.
If the Customer has prepaid for their stay, the Establishment may ask the Customer for a lump sum per person per day to guarantee the extras.
For distance sales made by telephone, Customers are informed that they must sign the sales receipt on arrival at the Château des Fleurs.
5. At the time of pre-payment, the amount debited at the time of reservation includes: the price of the accommodation, taxes related to the accommodation, the price of the restaurant if breakfast is chosen, taxes related to the restaurant and any other additional services selected by the Customer, excluding tourist tax and/or any other tax due as a result of the Customer's stay in the Hotel.
13. Personal information
1. Your personal data requested as part of your reservation, i.e. your title, surname, first name, postal address, telephone number with country code, e-mail address, payment card details (number, type of card, name of cardholder, expiry date and cryptogram if sent to us) and any data communicated or generated by your browsing constitute confidential data.
2. It is only accessible to BH Champs Elysées SAS, BH Hotels SAS, and to our subcontractor in charge of managing our ‘reservations’ pages and is used to process your reservations and stays and; provided that you have accepted by ticking the corresponding box, to send you our newsletter, or to respond to your requests or communicate commercial offers. They are kept for the time necessary for the commercial relationship established between the Customer and BH Champs Elysées SAS.
3. Certain information requested in the forms is compulsory and is indicated by an asterisk. If you choose not to provide this information, we will not be able to process your request.
4. In accordance with the French Data Protection Act of 6 January 1978, as amended, you have the right to access, rectify, delete and request a restriction on the processing of your personal data.
You also have the right to object to the processing of your data for legitimate reasons and the right to object to the processing of your data for commercial prospecting purposes, as well as the right to give us instructions on what to do with your data after your death.
Any natural person registered with the https://www.bloctel.gouv.fr or https://pro.bloctel.gouv.fr service is entitled to exercise their rights of access, rectification, limitation, deletion, portability and opposition to the processing of their data in accordance with Articles 12 et seq. of Regulation No. 2016/679 of the European Parliament. Any person also has the right to define directives relating to the fate of their personal data after their death, and in particular to lodge a complaint with a data protection supervisory authority, the CNIL in France, notably on the www.cnil.fr website.

14. Agreement of proof
1. Entering the required banking information, as well as accepting the present general conditions and the voucher or booking request, constitutes acceptance of the Hotel contract between the parties, having the same value as a handwritten signature.
2. The computerised registers kept in the computer systems of BH Champs Elysées SAS will be kept in reasonable conditions of security and will be considered as proof of communications, orders and payments between the parties.
15. Force majeure
BH Champs Elysées SAS could not be held responsible towards the Customer in the event of non-fulfilment of its obligations resulting from an event of absolute necessity.
In the same way, the Customer cannot be held responsible towards BH Champs Elysées SAS in case of non-execution of its obligations resulting from an event of force majeure.
Are considered as force majeure or fortuitous event those usually recognised by the French Courts.
16. Applicable law
These General Terms and Conditions of Sale are governed by French law.
17. Completeness
1. These General Terms and Conditions of Sale, the conditions of sale of the fare booked by the Customer, and the booking confirmation express the entirety of the obligations of the parties.
2. No general or specific conditions communicated by the Customer may be incorporated into these General Terms and Conditions.
3. The documents forming the contractual commitments between the parties are, in descending order of priority, the booking form or request (including the special conditions of the fare booked) which has been validated by the Customer and these general conditions.
4. In the event of any contradiction between the booking confirmation and these general terms and conditions, the provisions appearing on the booking confirmation will be the only ones applicable to the obligation in question.
18. Mediation
1. The customer is informed by Château des Fleurs of the possibility of having recourse, in the event of a dispute relating to these general conditions, to a conventional mediation procedure or any other alternative dispute resolution method, under the conditions set out in Title I of Book VI of the Consumer Code.
2. After having referred the matter to the customer service department or the hotel in an attempt to resolve the dispute amicably, and in the event of a negative response or the absence of a response within sixty (60) days from the date of referral, the customer may request the appointment of a mediator by AME Conso, 197 Boulevard Saint-Germain 75007 Paris or online at https://www.mediationconso-ame.com. Referral to the Mediation officer may be made within twelve (12) months of the first complaint.
3. BH Champs Elysées SAS also informs the customer of the existence of a European Online Dispute Resolution platform (‘RLL’) to which he/she may have recourse. The customer can access this platform via the following link: http://ec.europa.eu/consumers/odr/.
